    It is my understanding that anything made public with out a provisional patent or a patent becomes public knowledge, so presenting an idea with out a provisional patent at the minimum is absurd. Making a presentation like the one Nexa3D made costs more then a provisional patent... The filing fee is $130 for a small entity and drawings typically cost $100 to $125 per page, so a high quality provisional patent application for a mechanical or electrical device can typically be prepared and filed for $2,500 to $3,000 I don't believe this is a absurd price to ask you spend much more then that on prototyping...

    The problem comes when clearly there has been no verification... ANY lawyer with a minimum experience runs a priority art check before even filling for the patent, because filling for the patent will provide you with a number... and that number IS NOT a patent...you can file for a UFO and they will give you a provisional patent... now that surely is not a patent it is just a filling number, that is all... running around telling people you have a Patent is a lie... Nexa3d knows it, that it is why they are now saying...patent pending...

    Patent pending? another of those frequently misunderstood concepts in patent law. Is it valuable? Yes - it sometimes is, specially if you have done your priority art check, but if you choose not to run a priority art check or you did it but you don't care anyway because you have a window of opportunity then what is that called? That is called being opportunistic and a lair.

    Does filling for a Patent give you powerful legal rights? Not really.

    Once you have filed either a regular non-provisional U.S. filing or a provisional application you can legally and ethically proclaim that you have a "patent pending". Or, as some proclaim - "patent applied for".But what does that mean?

    Neither of these phrases have a strong legal meaning. By that I mean they do not mean that your product or process or method is protected by patent - yet. On the other hand, by being able to use these phrases you are announcing to the public that the process of obtaining a patent has been officially started and is pending in the patent office. That it itself is often enough deterrent to keep anyone from the idea of either trying to file a patent themselves or trying to create an infringing product.

    A common misconception of some is that just a patent pending will not stop an aggressive competitor from copying your product but in fact my experience has been that it is a deterrent. If you think about it very few companies are going to invest the money required to develop a new product that they might get shut out of later.

    This is the EXACT case with Nexa3d they KNOW there is a previous patent file on their "idea" I am telling them right here and now the number is as I have said before... PCT/CA2015/ 050860... don't you think it is risky enough? Without the added threat of infringement and what about their backers are they informed?

    A pending patent in and of itself gives you no legal right until a patent issues, THEY WILL NOT BE GRANTED A PATENT, SIMPLY BECAUSE THERE IS PRIOR ART and just so happens their prior art is IDENTICAL to the wording and drawings they use... coincidence?

    I have the same problem as I'm launching a Kickstarter project with a mobile patent pending technology. It would be IMPOSSIBLE for me to wait for final registration as it need 18 at least months in Portugal... But almost the same as in any other country.

    Me and my lawyer spent weeks looking for similar patents and we could find anything.

    In my opinion Kistarter is just a problem of trust: if I show celarly my name, I give my references etc... I hope will trust in me. If I'm a liar I don't

    Kistarter should be for startupper, not for already large companies with years of R&M behind ...

    Anyway I tried to look for the patent that Diego is mentioning. Why it doesn't works? I read about this story also on other website and he has been not able to prove anything about what he is saying. I think that without this, what your are saying with your seem fake.

    We everybody need to protect intellectual property, but before damaging a company in which people put his dreams, you should prove what you are saying.

    Wanda above all please share what they told you when you contacted them asking for clarification.

    Diego I hope you will find want your are looking for but I'm saying that the number you provide DOES NOT EXIST. Maybe a misspelling? Send us a link to verify. All patent should be public....

    MARK the same goes for them...if they have a patent show it!!! please you can go to the website we are now making...we are rushing to finish it it was not our intention to make one because we were not going public we are negotiating that patent now with he largest 3D printer company in the world...it was never our intention to go public, I cant disclose who but this is the truth... the website is www.newpro3d.com in a few minutes we will have our PCT registration record on site and the date is what is important!!!!

    ahi Diego I understand your situation and I'm so sorry, but how you are doing is not helping.

    Nexa3D is completely public in everything, from faces, to legal identity .... You are sharing a number that is NOT WORKING. If you share a picture it does not prove anything: share the link to the official database.

    I can't understand why you are not publishing and explaining this, seriously... is a suicide! Give us the link to check. Why is so difficult? You found their information and your are not able to give us a link? :o :o :o

    Why instead of that after saying a lot of words you just publish a link to your patent? It would solve everything. I'm also quite sure that if you write to Kickstarter it will suspend the campaign. Did you do it? What they told you?

    Please explain to me because I'm starting to think that you are not honest...

    P.s. I'd be more careful: I easly found that Thelyn own another patent on that field and the first one is 2014

    Ah Diego another question... did you read Thelyn patent? How could you verify that is the same patent? At least publish it...

    @markjr are you aware what a provisional patent is? What a PCT is? Google it. You will understand why you can not find it.
    Also, the earlier patent is not involving this new method of printing. This new method of printing is only a patent application meaning it has yet to be even reviewed. Therefore there is nothing to be read on their patent because it is non-existent.

    I'm not expert about PCT but as you says seems that Diego's patent is not provisional!

    before accusing somebody of fraud I should be able to prove it... don't you!?!?!?!? Otherwise are just words... not considering that a fraud is when somebody "copy" ... maybe they just had the same idea.

    but... if we everybody (you too can't find, correct? Or are you a friend of Diego?) are not able to find any information about your patent, how could Nexa do???

    Anyway I still I cannot understand why you don't publish this informations so anybody can evaluate...

    And still asking to my self: did you contact them or not? What they sad?

    Anyway guys I have to prepare my campaign ;) So no more time to spend.
